SPROUT’S “MR. MAILMAN’S SUMMER ADVENTURES” CONTEST

OFFICIAL RULES

NO PURCHASE IS NECESSARY TO ENTER OR WIN.

Sprout’s “Mr. Mailman’s Summer Adventures” Contest (“Contest”) starts on May 11, 2009 at 12:01 AM Eastern Time (“ET”) and ends on July 19, 2009 at 11:59 PM ET (“Contest Period”).

ELIGIBILITY: Contest is open to legal residents of the 48 contiguous United States and the District of Columbia, who are of the legal age of majority in the jurisdiction in which they reside (and at least 18 years of age) with a child or legal ward between 2 – 6 years of age. Entries should only be submitted by a parent or legal guardian of a child or legal ward between 2 and 6 years of age and be registered users of www.SproutOnline.com. Registration is free. Employees of PBS KIDS Sprout, Children’s Network LLC, its programming partners, Smart Television Alliance, and each of their respective parents, members, subsidiaries, affiliates, and advertising and promotion agencies, and members of their immediate family (spouse, parent, child, sibling and their respective spouses, regardless of where they reside) and persons living in the same household of such employee, whether or not related, are not eligible to enter or win. Void in AK and HI and where prohibited by law. Contest is subject to all applicable federal, state and local laws.

HOW TO ENTER: During the Contest Period, print the Mr. Mailman design posted in the Summer Portal of www.SproutOnline.com, cut it out and have your child color it. Take a photograph of the child on a summer adventure with Mr. Mailman, then return to www.SproutOnline.com and follow the directions provided to submit the color photograph and complete the entry form. Photograph must be submitted in GIF or JPEG format and cannot be larger than one (1) MB. All entries must be received by 11:59 p.m. ET on July 19, 2009. Limit one winner per registered user, but user may enter an unlimited number of unique entries. All entries become the sole property of the Sponsor and will not be returned.

Artwork in photograph must be entrant’s preschooler’s own work. Photograph must be taken by entrant, previously unpublished, and cannot have been submitted in connection with any other contest. Entry must only contain photos exclusively featuring your preschooler and/or your, be in keeping with the Sponsor’s image and may not be offensive or inappropriate, as determined by the Sponsor in their sole discretion, nor can it defame or invade publicity rights or privacy of any person, living or deceased, or otherwise infringe upon any person’s personal or property rights or any other third party rights. Sponsor reserves the right to disqualify any entry in which third parties other than you and your preschooler appear, that is in Sponsor’s sole discretion offensive or inappropriate, not in keeping with Sponsor’s images or that is otherwise not in compliance with these Official Rules.

By submitting a Photo, entrant hereby grants permission for the Photo to be posted on www.Sproutonline.com or other websites. Entrant agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Photos by third parties. Released Parties do not guarantee the posting of any Photo.

JUDGING: There will be two (2) rounds of judging: Round 1 – Weekly Winners: All eligible entries received by Sponsor will be reviewed by a panel of qualified judges equally on the following criteria: originality, creativity and playfulness. Judges will choose one winner each Tuesday from June 2, 2009 through July 21, 2009 (“Weekly Winner Selection Period”) from among all entries received to date through 11:59 pm on the Sunday preceding that week’s judging, for a total of eight (8) weekly winners:

  • Winner chosen June 2 from among all entries received May 11 – May 31.
  • Winner chosen June 9 from among all entries received May 11 – June 7.
  • Winner chosen June 16 from among all entries received May 11 – June 14.
  • Winner chosen June 23 from among all entries received May 11 – June 21.
  • Winner chosen June 30 from among all entries received May 11 – June 28.
  • Winner chosen July 7 from among all entries received May 11 – July 5.
  • Winner chosen July 14 from among all entries received May 11 – July 12.
  • Winner chosen July 21 from among all entries received May 11 – July 19.

Round 2 – Grand Prize Winner: All eight (8) Weekly Winners’ entries will be reviewed by a panel of qualified judges equally on originality, creativity and playfulness to select one (1) Grand Prize winner. Judges’ decisions are final and binding on all matters relating to this Contest.

WINNER NOTIFICATION: Round 1 – Weekly Winners: Potential Weekly Winners (who will be the eligible individual submitting the entry and not the preschooler whose art is depicted) will be notified by telephone and/or email during the Weekly Winner Selection period. Each week’s Weekly Winner’s name will be announced on The Sunny Side Up Show each Friday from June 5, 2009 through July 24, 2009. Prior to Round 2, all Weekly Winners will be required to execute an Affidavit of Eligibility, Liability Release and Publicity Release (unless prohibited by law), which must be returned by the date appearing on prize notification. Round 2 – Grand Prize Winner: The Grand Prize winner’s name will be announced on The Sunny Side Up Show on July 31, 2009.

Return of prize or prize notification as undeliverable, failure to execute and return requested documentation within the allotted timeframe, Sponsor’s inability to contact potential winner within a reasonable time period or noncompliance with these Official Rules by potential winner will result in disqualification and, at Sponsor’s discretion, the prize may be awarded to the runner-up. Sponsor reserves the right to notify winner and/or award the prize in person and to record, photograph and videotape the visit and any other activities in which winner may be involved at such time and to use and permit use of said recordings, and the name, likeness, performance and statements of the winner embodied therein, in any and all media now known or hereafter created throughout the world in perpetuity, without further compensation, approval or notice. Once winner has returned all paperwork and has been fully qualified, the winner and his/her entry and information will be posted on www.SproutOnline.com. This is anticipated to occur beginning June 5, 2009.

PRIZES/ODDS: Odds of winning depend on the number of eligible entries received. Eight (8) Weekly Winners will each receive a Sprout gift pack with an approximate retail value ("ARV") of $60.00. One (1) Grand Prize will be awarded consisting of the following: a trip for four (4) people to Philadelphia, PA for 4 days/3 nights (the "Trip"). The Trip consists of (i) round trip coach class air transportation for four (4) on a carrier of Sponsor’s choice from the major airport closest to winner's residence to Philadelphia, PA; (ii) one standard hotel room (quad occupancy; room rate and tax only) for three (3) nights in Philadelphia, PA; (iii) mid-sized rental vehicle for duration of prize package in Philadelphia (note: primary renter must be 25 years of age or older and be in possession of a major credit card and valid driver’s license in the same name.); (iv) daily breakfast for each guest; (v) daily valet parking for one vehicle for the duration of the prize package; (vi) four (4) tickets to Sesame Place; (vii) four (4) tickets to the Please Touch Museum; (viii) meet and greet opportunity with the Sprout character(to be determined by Sponsor in its sole discretion).

The total ARV of the Grand Prize is $5,775.00. The actual value will vary depending on winner’s city of departure. Therefore, the actual value of the Grand Prize awarded may be lower or higher than the ARV at the time of fulfillment. If the stated ARV exceeds the actual value, the difference will not be awarded in cash. Sponsor may substitute for air travel if winner lives in close proximity to Philadelphia. All expenses or costs incurred by winner or winner's travel companions associated with the Grand Prize receipt or use that are not specifically and expressly stated herein above are not included in the Grand Prize package and are the sole responsibility of the winner and his/her travel companions. Such expenses and costs may include, without limitation, any additional ground transportation, meals, incidentals, tips, telephone calls or other personal expenses and costs not specified herein but relating to the use or acceptance of the Grand Prize package which are the sole responsibility of the Grand Prize winner and his/her travel companions. Travel must be completed by March 31, 2010, or winner may forfeit prize. Travel is subject to availability and blackout periods. Selection of airline carrier and hotel are at the sole discretion of Sponsor. Additional restrictions may apply. Grand Prize winner and his/her travel companions will be required to travel on the identical itinerary. Grand Prize winner and travel companions are responsible for obtaining identification documents and/or other travel documents required for the Trip. Sponsor will not replace any lost or stolen tickets, vouchers, certificates, prizes or prize components once they are in the Grand Prize winner's possession. No transfer, or cash or other substitution of any prize allowed except by Sponsor, which reserves the right to substitute the prize with one of comparable or greater value. All prize details are at Sponsor’s sole discretion. Sponsor reserves the right to cancel the Show. Travel and accommodations are subject to availability and certain restrictions.

All taxes and all expenses related to acceptance and use of prize and not specified herein are the sole responsibility of winners. Grand Prize winner will be issued an IRS 1099 form for the approximate retail value of their prize. The travel companions or their legal guardians of potential Grand Prize winner must sign and return a Liability and Publicity Release prior to travel documents being issued, except where prohibited. Such documents must be signed and returned by the date and/or time indicated within such documents. If a potential winner fails to return required documentation in a timely manner, the prize will be forfeited and an alternate winner will be selected.

OWNERSHIP/USE: By submitting an entry, entrant agrees that Sponsor shall own the entry submitted (including all rights embodied therein) and that they and their designees may exploit, edit, modify, and distribute the entry and all elements of such entry, and shall have the right to use entrants name, likeness, performance and statements of entrant and his/her child or legal ward in any and all media (including on www.SproutOnline.com or other websites) now known or not currently known, throughout the world in perpetuity without compensation, permission or notification to entrant or any third party.

GENERAL: By participating, each entrant agrees: (a) to abide by these Official Rules and decisions of Sponsor and judges, which shall be final and binding in all respects relating to this Contest; (b) to release, discharge and hold harmless Sponsor, Children’s Network LLC, its programming partners, and their respective parents, members, affiliates, subsidiaries, and advertising and promotion agencies, and the respective officers, directors, shareholders, employees, agents and representatives of the forgoing (collectively, “Released Parties”) from any and all injuries, liability, losses and damages of any kind to persons, including death, or property resulting, in whole or in part, directly or indirectly, from entrant’s participation in the Contest, the acceptance, possession, use or misuse of any awarded prize or Released Parties’ use of any of the rights granted herein or any use of entry submitted; and (c) to the use of his/her name, city and state of residence, photograph/video, image and/or likeness for programming, advertising, publicity and promotional purposes in any and all media, now or hereafter known, worldwide and on the Internet, and in perpetuity by Sponsor and their designees, without compensation (unless prohibited by law) or additional consents from entrant or any third party and without prior notice, approval or inspection, and to execute specific consent to such use if asked to do so.

Released Parties are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered or garbled entries; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the Contest, including, without limitation, errors or difficulties which may occur in connection with the administration of the Contest, the processing or judging of entries, the announcement of the prizes or in any Contest-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the Contest. Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this Contest or downloading materials from or use of the web site. Persons who tamper with or abuse any aspect of the Contest or website or who are in violation of these Official Rules or who attempt to undermine the legitimate operation of the Contest by cheating, deception or other unfair playing practices, or intend to annoy, abuse, threaten or harass any other entrant or Sponsor’s representatives, as solely determined by Sponsor, will be disqualified and all associated entries will be void. ANY ATTEMPT TO DELIBERATELY UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE IN VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR RESERVES THE RIGHT TO SEEK DAMAGES AND OTHER REMEDIES (INCLUDING ATTORNEYS’ FEES) FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT OF THE LAW, INCLUDING CRIMINAL PROSECUTION. Should any portion of the Contest be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, Sponsor reserves the right at their sole discretion to suspend, modify or terminate the Contest and, if terminated, at their discretion, award the prize from all eligible, non-suspect entries received prior to action taken using judging procedure specified above.
